Terms of Service

1. Acceptance of Terms

By accessing or using FanClash (the "Service"), operated at https://fanclash.appand through our mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use FanClash. By creating an account, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload or share content that is offensive, harmful, threatening, abusive, or otherwise objectionable
  • Impersonate any person or entity
  • Manipulate votes, rankings, or leaderboards through automated means or multiple accounts
  • Interfere with or disrupt the Service or its servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use bots, scrapers, or automated tools to interact with the Service
  • Harass, bully, or intimidate other users

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion.

5. Virtual Currency (Zems)

5.1 Purchased Zems

FanClash offers a virtual currency called "Zems" that can be purchased through in-app purchases via the Apple App Store or Google Play Store. Purchased Zems are non-refundable, have no cash value, and cannot be exchanged for real currency. Zems can be used to boost votes, enter premium tournaments, and access other in-app features.

5.2 Earned Zems

You may earn Zems through gameplay activities such as winning tournaments, completing challenges, and leveling up. Earned Zems are tracked separately in your wallet. Earned Zems may be eligible for withdrawal, subject to admin approval and any applicable minimum thresholds or fees. FanClash reserves the right to modify or discontinue the Zem withdrawal program at any time.

5.3 Zem Balance

FanClash reserves the right to manage, regulate, modify, or eliminate Zems at any time. In the event of account termination for Terms violations, any remaining Zem balance (purchased or earned) may be forfeited.

6. Subscriptions

FanClash offers optional subscription plans: Pro ($4.99/month) and Elite ($14.99/month). Subscriptions auto-renew through the Apple App Store or Google Play Store unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's app store settings. Refunds for subscriptions are handled by Apple or Google according to their respective refund policies.

7. User Content

You retain ownership of content you create on FanClash (vote lists, comments, profile information). By posting content, you grant FanClash a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.

You are solely responsible for the content you post. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

8. Intellectual Property

The FanClash name, logo, and all related branding, software, design, text, and graphics are the property of FanClash and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Voting and Tournaments

FanClash provides voting matchups, tournaments, and competitive features for entertainment purposes. Results are determined by user votes and platform algorithms. FanClash does not guarantee any particular outcome and reserves the right to modify, cancel, or restart any tournament or voting event at its discretion.

10. XP and Leveling

Users earn experience points (XP) through participation in voting, tournaments, and other activities. XP determines your user level, which unlocks features such as the ability to create vote lists (Level 4) and tournaments (Level 6). XP has no monetary value and cannot be transferred or exchanged.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. Your use of the Service is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, FanClash shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of Zems, loss of data, or loss of anticipated benefits.

13. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, disclaimers, limitation of liability, and governing law survive termination.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of FanClash after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
